There have recently been various reports on the Savings bank's privatization, including allegations that the tax amount the bank previously transferred to the state budget had decreased.
To verify these reports I met with Mr. B. Batgerel, inspector at Information processing unit of National Tax Authority, to request information on the taxes paid by the Savings bank from 2003 to 2005. However, B. Batgerel refused to give me information unless I got hold of his boss's signature. It is disappointing that I did not receive any assistance in obtaining declassified information of such nature. Does it have to do with the fact that National Tax Authority, has established such rigid rules within its walls or with B. Batgerel's bureaucratic manners?

According to lawyers comment, the information regarding a tax amount which paid for State budget of 2003-2005 of the Saving bank does not includes to any area of information that legally protected as secret.
There are any article in the Law on Mongol Bank, Law on bank, Law on State Secret as well as Law on Privacy of Organizations to classify this kind of information as secret. An annual finance report of each bank that operates in Mongolia should be audited and after that it should be informed to the public through media as the Law on bank of Mongolia required. Under the Law on Organizational Secrecy of Mongolia which enacted in 1995, the organization should define its privacy by their own and set out an area of privacy and also a number of areas which not be confidential such as “The information regarding a crime and information which should be informed to the public as law obliges”.
Furthermore, a citizen’s right to receive information are guaranteed in Article 17 of the Constitution of Mongolia which states: “the right to seek and receive information except that which the state and it’s bodies are legally bound to protect as secret”.
In addition to this, the right to know and the access to information is one of main tools of empowering citizen, making the government more transparent and open, accountable and responsible.
